This article reveals the outcome of a study on the perceptions of elders, family members, and healthcare professionals and administration providing care in a range of different long-term care facilities in Hong Kong with primary focus on the concepts of autonomy and dignity of elders, quality and location of care, decision making, and financing of long term care. It was found that aging in place and family care were considered the best approaches to long term care insofar as procuring (...) and balancing the values of dignity, autonomy, family integrity and social sustainability were concerned. An elder having the final say was generally accepted. The results also initiated the importance of sharing of financial responsibility among elders, children and government albeit the emphasis was placed on individuals. Furthermore, dignity of elders was not considered purely a synonym of autonomy, but it had also to do with respect, family and social connections. (shrink)

This paper investigates the drivers and inhibitors of Internet privacy concern. Applying the Multidimensional Development Theory to the online environment, we identify the important factors under four dimensions—i.e., environmental, individual, information management, and interaction management. We tested our model using data from an online survey of 2417 individuals in Hong Kong. The results show that the factors under all four dimensions are significant in the formation of Internet privacy concern. Specifically, familiarity with government legislation, Internet knowledge, benefit of information (...) disclosure, privacy protection, and social presence reduce Internet privacy concern, while individuals’ previous privacy invasion experience, risk avoidance personality, and sensitivity of information requested by websites increase Internet privacy concern. We conducted an analysis of unobserved heterogeneity to confirm the significance of these factors. A follow-up moderation analysis shows that the individual factors moderate the effects of the information management factor and the interaction management factors. What is belief? "Beliefs aim at truth" is the commonly accepted starting point for philosophers who want to give an adequate account of this fundamental state of mind, but it raises as many questions as it answers. For example, in what sense can beliefs be said to have an aim of their own? If belief aims at truth, does it mean that reasons to believe must also be based on truth? Must beliefs be formed on the basis of evidence alone? (...) Is truth the constitutive norm of belief? Does aiming at truth bring in a normative dimension to the nature of belief? How can the aim of truth guide the formation of our beliefs? In what ways do partial beliefs aim at truth? Is truth the aim of epistemic justification? Last but not least, is it knowledge rather than truth which is the fundamental aim of belief? In recent years, pursuing these questions has proved extremely fertile for our understanding of a wide range of current issues in philosophy of mind and action, epistemology, and meta-ethics. It is very natural to think that if two people, x and y, are qualitatively identical and have committed qualitatively identical actions, then it cannot be the case that one has committed something wrong whereas the other did not. That is to say, if x and y differ in their moral status, then it must be because x and y are qualitatively different, and not simply because x is identical to x and not identical to y. One version of Moore’s Paradox is the challenge to account for the absurdity of beliefs purportedly expressed by someone who asserts sentences of the form ‘p & I do not believe that p’. The absurdity of these beliefs is philosophically puzzling, given that Moorean sentences are contingent and often true; and express contents that are unproblematic when presented in the third-person. In this paper I critically examine the most popular proposed solution to these two puzzles, according to which Moorean beliefs (...) are absurd because Moorean sentences are instances of pragmatic paradox; that is to say, the propositions they express are necessarily false-when-believed. My conclusion is that while a Moorean belief is a pragmatic paradox, it is not just another pragmatic paradox, because this diagnosis does not explain all the puzzling features of Moorean beliefs. In particularly, while this analysis is plausible in relation to the puzzle posed by characteristic of Moorean sentences, I argue that it fails to account for. I do so in the course of an attempt to formulate the definition of a pragmatic paradox in more precise formal terms, in order to see whether the definition is satisfied by Moorean sentences, but not by their third-person transpositions. For only an account which can do so could address adequately. After rejecting a number of attempted formalizations, I arrive at a definition which delivers the right results. The problem with this definition, however, is that it has to be couched in first-person terms, making an essential use of ‘I’. Thus the problem of accounting for first-/third-person asymmetry recurs at a higher order, which shows that the Pragmatic Paradox Resolution fails to identify the source of such asymmetry highlighted by Moore’s Paradox. The present study illustrates the philosophical foundations of business management, based on dialogues with five eminent corporate executive officers (CEOs). It reveals that the CEOs practice a style of (...) Chinese leadership synthesizing Confucian, Daoist, Mohist, and Legalist doctrines. The Confucian doctrines advocate benevolence, harmony, learning, loyalty, righteousness, and humility. They are the most prevalent tenets that support paternalism and collectivism. The Daoist doctrines emphasize flexibility and reversion (e.g., the principle that the weak can defeat the strong). They bolster the leader’s forbearance. The Mohist doctrines underpin thrift and working with the masses whereas the Legalist doctrines inculcate self-control and innovativeness. Hence, contemporary Chinese leadership does not rely exclusively on Confucian ethics and this reflects evolution over 1000s of years. (shrink)

This paper is aimed at investigating the differences in ethical perception between Mainland China and Hong Kong through qualitative analysis. The level of idealism and relativism of the informants are measured quantitatively. The qualitative analysis of the viewpoints of participants from Hong Kong and other Chinese cities offers a profound understanding of ethical perception. Contradicting previous studies, our research offers a fresh perspective, indicating that those with high idealism are not always the ones who condemn misconduct or advocate (...) for whistle-blowing. Interestingly, we noted that individuals with high relativism frequently consider and emphasize alternative perspectives, rather than merely condemning or advocating misconduct and whistle-blowing. Conversely, those with low relativism frequently exhibit more anger, regardless of their stance. This discovery suggests that high relativism could be beneficial for facilitating communication between conflicting parties. (shrink)

This paper offers a brief historical survey of the development of analytic philosophy in Hong Kong from 1911 to the present day. At first, Western philosophy was a minor subject taught mainly by part-time staff. After the Second World War, research and teaching in analytic philosophy in Hong Kong began to grow and consolidate with the expansion of higher-education and the establishment of new universities. Analytic philosophy has been a significant influence on comparative and Chinese philosophy and played (...) a crucial role in the teaching and promotion of critical thinking. Analytic philosophers in Hong Kong are now active participants in the global philosophical community. We review the development of analytic philosophy across the major tertiary institutions in Hong Kong and discuss some of the future challenges faced by the discipline. (shrink)

Based on selected writings on women's experiences of and reflections on dress and travel published in the Hong Kong feminist journal Nuliu, this paper discusses the politics of female subjectivity in relation to the everyday. The context of the discussion is the changing actualization of the well-known feminist slogan ‘the personal is political’ within the local feminist movement in Hong Kong between the 1980s and the 1990s. The paper aims to create a new paradigm for analysing agency – (...) the key concept in subject formation – by critiquing the ideology of choice, which is a liberal value system that connects people's imagination with the notion of personal ‘liberation’. As demonstrated by the examples of dress and travel, the everyday is a site of both possibilities and conflict for women, who generate new strategies or tactics to negotiate not only with institutions, structures and policies, but also with ‘interpellations’, ‘temporality’, ‘spatiality’, ‘performativity’, ‘symbolism’ and ‘psyche’. This paper critically evaluates the Hong Kong government's recent attempt to introduce cross-curricular themes into the school curriculum. It is agued that the policy failed to have a significant impact because many of its key elements defined the themes as marginal and dispensable. Moreover, the policy embodied a discourse which portrayed teachers as empowered and, consequently, as the primary source of problems of its implementation.

Flipped learning could improve the learning effectiveness of students. However, some studies have pointed out the limitations related to flipped classrooms because the content of the flipped course does not vary according to the needs of the students. On the other hand, adaptive teaching, which customizes the learning mode according to the individual needs of students, can make up for some of the shortcomings of flipped teaching. This study combines adaptive teaching with flipped teaching and applies it to face-to-face classroom (...) activities. The purpose of this research is to explore whether the implementation of flipping and adaptive learning in a computer programming course can improve the learning effectiveness of students. The experimental subjects of this study are the sophomore students in the Department of Information Management. The flipped classroom with adaptive instruction has been realized in the limited course time. This study uses questionnaires to collect pre- and post-test data on the “learning motivation” of students. The learning effectiveness was evaluated based on the students' previous programming course and the semester scores of this course. Research results show that the post-test “learning motivation” has improved overall compared with the pre-test, and the learning effect is significant. The results of this research not only prove the effectiveness of modern teaching theories in programming courses but also lay the foundation for future teaching design. (shrink)

In this paper, we describe four broad ‘meta-methods’ employed in scientific and philosophical research of qualia. These are the theory-centred metamethod, the property-centred meta-method, the argument-centred meta-method, and the event-centred meta-method. Broadly speaking, the theory-centred meta-method is interested in the role of qualia as some theoretical entities picked out by our folk psychological theories; the property-centred meta-method is interested in some metaphysical properties of qualia that we immediately observe through introspection ; the argument-centred meta-method is interested in the role of (...) qualia in some arguments for non-physicalism; the event-centred metamethod is interested in the role of qualia as some natural events whose nature is hidden and must be uncovered empirically. We will argue that the event-centred metamethod is the most promising route to a comprehensive scientific conception of qualia because of the flexibility of ontological and methodological assumptions it can provide. We also reveal the hidden influences of the different meta-methods and in doing so show why consideration of meta-methods has value for the study of consciousness. (shrink)

Warren Quinn and Philippa Foot have given versions of the Doctrine of Doing and Allowing justifying a moral distinction between doing something to bring about harm, and doing nothing to prevent harm. They argue that it is justified to allow one person to die so that one can save a larger number of people, but not to kill one person to achieve the same purpose. In this chapter, I show that the examples typically used to support the DDA do not (...) in fact do so. Contrary to the deontological ethics supported by the DDA, I argue that it can be justified to minimize harm by killing a smaller number of people, in preference to letting a greater number die. But unlike for the consequentialist, my position is that the distinction between killing and letting die does have moral significance. I shall examine what other non-consequentialist considerations, besides the appeal to positive and negative rights, could account for the distinction; and suggest a middle position between the deontological and consequentialist approaches to the ethics of killing. With Internet users constantly participating in online interactions, a wide range of novel usages have emerged, some of which involve multi-word expressions. The use of multi-word expressions in online discourses has not been fully explored. Therefore, this study sets out to investigate the Chinese word string bù shuō le ‘not talk anymore’, which occurs much more frequently in online discussion boards than in other written or spoken modes. In the corpus-based analysis, multiple contexts in which bù shuō le indicates a (...) reluctance to further elaborate are identified. The most common context is that the writer recounts a face-threatening experience and uses bù shuō le to bring the post to the conclusion, express a casual attitude toward that experience, and exert a humorous effect. This study contributes additional evidence that demonstrates how multi-word expressions fulfill textual, expressive, and interpersonal functions in online discourses. (shrink)

This chapter discusses some legal implications of Hong Kong’s three types of organ donation incentive and presents further thoughts about their ethical and policy implications. It aims to transform the useful findings presented in previous chapters into legal solutions and policy innovations in practice. We argue that the Hong Kong law is able to incorporate mixed incentive measures and further suggest detailed legal rules regarding organ incentives for the government to consider. In terms of ethical and policy implications (...) in a wider context, we suggest a paradigm shift in incentive structure and the adoption of mixed incentive measures for the promotion of organ donation and procurement. However, we agree that the exact choice or combination of organ incentive measures ultimately depends on how each country or jurisdiction will assess their practical effectiveness, political legitimacy, and ethical justification. This paper examines the practice of informed consent in Hong Kong by drawing on structured interviews conducted with eleven physicians, three patients, and four family members primarily at a well-established public hospital in Hong Kong. The findings of this study show that the Hong Kong approach to medical decision-making lies somewhere between that of America on the one hand, and mainland China on the other. It is argued that the practice of medical decision-making in Hong Kong (...) can be modeled by a moderate familism that is directed towards achieving the best interests of the patient (1) as understood by the physician, (2) in consultation with the family, (3) under the prima facie presumption that consent is not required for disclosure of information to the family, (4) while aiming at an eventual albeit frequently partial and vague disclosure to the patient. Kripke's argument for the rigid designation of natural kind terms is fallacious because he does not distinguish natural kinds from second-order functional properties; by clarifying the concepts of natural kind and functional property, we can show that natural kind terms do designate their referents rigidly, but that functional property terms are not rigid designators. My discussions of functional property will also help dispel the worry about the alleged cases of contingent identity with regard to theoretical statements in science. In recent years, there has been increased awareness of unethical consumer practices in Asian countries. Asian consumers have gained a bad reputation for buying counterfeit products, such as computer software, fashion clothing and watches. In 1993, the estimated losses to US software companies due to Chinese counterfeiting stood at US $322 million (Kohut, 1994). The present study uses a consumer ethics scale developed by Muncy and Vitell (1992) to investigate consumers' ethical judgments from a Chinese perspective. The result shows that (...) consumers in different cultures utilize similar rules to assess the ethicality of a given situation. However, findings also show certain cultural elements that are unique in influencing Chinese consumers' ethical judgments. The results also indicate the need for the continued development of and investment in consumer education in Asia. (shrink)

Education is so strongly emphasized in the Chinese culture that academic success is widely regarded as the only indicator of success, while too much physical activity is often discouraged because it drains energy and affects academic concentration. This study investigated the relations among academic achievement, self?esteem, school conduct and physical activity level. The participants were 333 Chinese pre?adolescents (aged 8?12) in Hong Kong. Examination results and conduct grades were obtained from the school records. Global self?esteem was measured with the (...) Physical self?description questionnaire (PSDQ), while physical activity patterns of the children were assessed with the Physical activity questionnaire for children (PAQ?C). Results showed that high academic achievers consistently attained better school conduct marks. However, physical activity level was quite an independent entity that was related neither to academic achievement nor school conduct. Furthermore, regression analyses showed that only academically high?achieving boys and physically active boys had higher self?esteem. (shrink)

In this dissertation, I try to answer the following somewhat Kantian question: How is mental causation possible? For the discussion of the nature of mental properties, I accept the two tenets of functionalism: the multiple realizability thesis and the functional conception of mental properties as causal intermediaries between physical causes and effects. I then introduce the following two principles: the principle of physical realization and the principle of causal power identity. It is the principle of physical realization that dictates that (...) every mental property be physically realized for its instantiation. The principle of causal power identity ensures that the causal power of a mental property is identical with those of its physical realizers. I suggest that the realization relation between the mental and the physical be understood in such a way that a mental property has causal powers identical with those of its physical realizers, but that the mental property itself is not reduced to its physical realizers because the two kinds of properties are not identical. Mental properties are realized in physical properties, and the causal powers of mental properties are identical with those of physical properties; therefore, mental properties are as causally efficacious as their physical realizers. Since mental properties are not reducible to physical properties, they enjoy autonomy with the full causal powers of their realizers. To conclude, mental properties do not lose out to epiphenomenalism; and they have their own autonomy. (shrink)

Are today’s wars different from earlier wars? Or do we need a different ethics for old and new wars alike? Unlike most books on the morality of war, this book rejects the ‘just war’ tradition, proposing a virtue ethics of war to take its place. Like torture, war cannot be justified. This book asks and answers the question: “If war is a very great evil, would a leader with courage, justice, compassion, and all the other moral virtues ever choose to (...) fight a war?” A ‘philosophy of co-existence’ is proposed which is much more restrictive than just war theory but not pacifist. War can be correctly chosen by a virtuous leader only in rare ‘supreme emergencies’ when faced with enemies as evil as Hitler. This virtue ethics approach to war is used to find new answers to difficult issues such as humanitarian intervention, terrorism and weapons of mass destruction. (shrink)

Objective: Even when critically ill patients are almost certain to die from their illnesses, there is generally an element of prognostic uncertainty. Little is known about how physicians handle this uncertainty in conversations with surrogate decision makers. We sought to evaluate whether and how physicians discuss prognostic uncertainty with surrogate decision makers of patients who are highly likely, but not certain, to die. Design: We audiotaped and transcribed discussions between clinicians and surrogate decision makers at two major California teaching hospitals (...) from 2006 through 2008. Physicians completed a questionnaire addressing their prognostic estimates for patients' survival to hospital discharge. Participants: We included physicians and surrogates of 12 incapacitated, critically ill patients. Measurements: We analyzed transcripts of discussions in which physicians' estimates of patients' chances of hospital survival were 1% to 5%; we coded whether physicians disclosed the prognostic uncertainty and, if so, how they conveyed that death was highly likely but not certain. Results: Physicians' estimates of short-term survival were 1% to 5% for 12 of the 70 patients enrolled in the original study. In 8 of 12 cases, physicians conveyed prognostic uncertainty by using probabilistic language or by an explicit mention of uncertainty. In four cases, physicians made at least one statement that either implied or was ambiguous about whether death was certain. Conclusion: We observed variability in how physicians handle prognostic uncertainty in their discussions with surrogates of patients who are highly likely, but not certain, to die, including some circumstances in which physicians stated or implied that death was certain. This chapter gives an outline of the development of the human organ transplant system in Hong Kong, whose key features are a soft opt-in system and strict prohibitions on commercial dealings in human organs for transplant. It is argued that under such a system, there is a lack of incentives for either cadaveric or living organ donations and for family members to endorse deceased donation. This argument is followed by an investigation of the shortage of organ donations in (...) class='Hi'>Hong Kong, the limited success of the government promotion to improve the number of donations, and a discussion of new alternatives for improvement that have been initiated or proposed. It is argued that the feasibility and effectiveness of these alternatives are limited and uncertain. More radical reform of the existing system in terms of honorary, compensationalist, and familist incentives is needed and they all need to be taken into consideration. (shrink)

O objetivo deste artigo é descrever o grau de parentesco existente entre várias famílias de origem chinesa que se estabeleceram em Nicoya e analisar como isso influenciou suas contribuições para o desenvolvimento socioeconômico da cidade e seus padrões de mobilidade em todo o Pacífico da Costa Rica desde final do século XIX até meados do século XX. Os participantes do estudo são descendentes de imigrantes que se enraizaram em Nicoya entre 1880 e 1950, que possuíam duas peculiaridades: pertenciam aos mesmos (...) clãs familiares, apesar dos diferentes sobrenomes com os quais estavam registrados ou eram da mesma área geográfica e, às vezes, até da mesma aldeia, que desenvolveu laços de afinidade tão fortes quanto laços consanguíneos. Isso lhes permitiu apoiar-se mutuamente para alcançar o desenvolvimento coletivo do grupo de imigrantes chineses em Nicoya. (shrink)

The ethics of gene patenting is concerned with whether human genes are the kind of thing that is appropriate for patenting, and whether it is ethical to do so. Is genetic technology a special case compared to other medical technology that have been patented? Much of the debate has revolved around the benefits and harms of allowing gene sequences to be patented. In this paper, I am concerned with a non-consequential consideration: Can someone patent my genes? If genes are the (...) common property of humankind, are genes patentable? I present an objection to the patenting of processes used to manipulate our genes that have the potential to change human nature. Should not all members of the human species have a say regarding genetic engineering that can be used to irreversibly change what makes each one a human? Este artigo irá examinar a concepção de Agostinho de Hipona sobre o coração humano, visto que, ocupando o lugar de um cardiologista, Agostinho prescreve um tratamento terapêutico intensivo. Serão considerados três movimentos essenciais do cor agostiniano. Primeiramente, Agostinho propõe uma busca pelo coração, a câmara secreta, o centro vital interior que necessita ser reencontrado. Uma vez localizado o coração, somos levados a um segundo movimento: o retorno ao coração. Depois de diagnosticar sua própria doença cardíaca, um coração vazio, Agostinho propõe (...) uma terapia, a volta ao coração no encontro com um terapeuta divino, o Cristo; e um remédio potente, o esmagamento do coração. Terceiro, ascende-se com seu coração: o coração se eleva ao alto, sursum cor. Um coração saudável é um coração ascendente, com o amor como seu marca-passo. Retornar ao coração significa, portanto, voltar ao núcleo de uma autêntica existência, no chamado para não se fechar em si mesmo, para ascender em uma abertura de amor a uma alteridade, Deus e ao próximo. Como epílogo, iremos explorar de forma concisa dois contextos relacionados, nos quais Agostinho utiliza a imagem do coração: vida comunitária e espiritualidade. (shrink)

Recent ethical and legal challenges have arisen concerning the rights of individuals over their IVF embryos, leading to questions about how, when the wishes of parents regarding their embryos conflict, such situations ought to be resolved. A notion commonly invoked in relation to frozen embryo disputes is that of reproductive rights: a right to have (or not to have) children. This has sometimes been interpreted to mean a right to have, or not to have, one's own genetic children. But can (...) such rights legitimately be asserted to give rise to claims over embryos? We examine the question of property in genetic material as applied to gametes and embryos, and whether rights over genetic information extend to grant control over IVF embryos. In particular we consider the purported right not to have one's own genetically related children from a property-based perspective. We argue that even if we concede that such (property) rights do exist, those rights become limited in scope and application upon engaging in reproduction. We want to show that once an IVF embryo is created for the purpose of reproduction, any right not to have genetically-related children that may be based in property rights over genetic information is ceded. There is thus no right to prevent one's IVF embryos from being brought to birth on the basis of a right to avoid having one's own genetic children. Although there may be reproductive rights over gametes and embryos, these are not grounded in genetic information. (shrink)

It was a common practice of the Chinese official historiographers to employ pseudo-historical, semi-fictional source materials alongside the factual, ascertainable data in their narratives for prescribed political or didactic purposes despite their commitment to the time-honored principles of truth and objectivity in the Confucian-oriented traditional historiography. The intrusion of these non-historical elements in the imperial historical records illustrates, therefore, the adaptability of the source materials representing the popular tradition of the masses for the uses of the great tradition, and the (...) propensity of the reciprocal exchanges between the expressions of the Confucian literati and the less cultured populace in historical compositions. Drawing on a textual analysis of the T'ai-tsu shih-lu, the reign chronicle of the Ming founder Chu Yüan-chang, who rose from a humble peasant to the imperial throne in 1368, this essay examines the historical circumstances and historiographical devices by which the factual records were commingled with the non-historical materials in the accounts of the dynasty founding. It shows how the historiographers synthesized the pseudo-historical expressions in the popular tradition with the deliberately fabricated falsehoods of their own doing to conjure up an inflated portrait of the Ming founder, transforming him from an illiterate, beggar mendicant monk and rebel leader into the topoi of a righteous hero, dynasty founder and exemplar ruler in traditional official historiography. It also shows that apart from the historiographers' penchant for conformity to the established conventions, the exaggerated portrait of the Ming founder in the T'ai-tsu shih-lu was a product of a historiographical revision undertaken on order of the third emperor Yung-lo, fourth son of T'ai-tsu, aiming at legitimizing his usurpation of the throne from his nephew the imperial successor Chien-wen in a palace rebellion of 1402. Lastly, it shows how the early Ming revision of the records of the rise of T'ai-tsu inspired a cycle of bizarre legends about the early years of the dynasty founding in later official and private writings, and how a case study of such historiographical process may add to our understanding of the continuous interactions between the expressions of the élite and mass heritages in the making of the Chinese intellectual and cultural traditions. This paper aims to reconstruct the history of the first transatlantic wireless telegraphy on the basis of J. A. Fleming's unpublished notebooks and other manuscript sources. It will be shown that the progress of the experiment, in which power engineering was first combined with wireless telegraphy, was neither smooth nor automatic, and various kinds of difficulties or ‘resistances’ that Fleming and Marconi encountered during the course of the experiments in the laboratory and in the field at Poldhu will be emphasized. (...) This paper also aims to compare two different ‘styles’ of engineering. Fleming, whose educational background included Cambridge experimental physics, based his approach upon scientific engineering—that is, laboratory experiments, precise measurement, and mathematical considerations, whereas Marconi's work derived from an older style of doing technology—that is, field experiments, handicraft work, and an intuitive understanding of technological effects. These two different styles clashed in the experiment, and it will be shown that this tension became apparent when credit for a project's success was being assigned. (shrink)

The concept of yu 欲 is an under-explored concept in the scholarship on early Confucianism. Perhaps due to the focus on the term “the yu of eyes and ears,” a common term in early Chinese philosophy denoting desires for sensual gratification, or on the Daoist stance on desires, many scholars tend to emphasize the negative and the hedonistic connotations of the term. For example, Chad Hansen notes that the early Confucians do not “make desires central in their account of human (...) guidance,”1 and that Confucius uses “desire” “more to describe dispositions that conflict with his favored dao.”2 In the same vein, when many scholars analyze Xunzi’s account of desires they focus on its... The Chinese philosophical tradition aims at a departure from the imperfect reality for the sake of the ideal. But it is also clear to the Chinese philosophers that most people would not follow their footsteps in discarding reality and seeking the ideal. The weakness of the ideal in its incapacity to change the uncultivated man defines a common thread of philosophical thinking in China, and constitutes a bitter truth which these philosophers do not make explicit. Seven philosophers from the fifth (...) to the third centuries B.C.E. are analyzed in order to develop a fresh understanding of the dialectic between the ideal and the uncultivated man: Lao Tzu, Confucius, Mo Tzu, Mencius, Chuang Tzu, Hsun Tzu, and Han Fei. Although I treat them individually rather than group similar topics for comparison, I employ a consistent mode of analysis to study each of them. ;I find that Mo Tzu perceives reality as an oppressive order and attributes it to the egoism of the uncultivated man; and under his system, oppression will prevail since Mo Tzu's proposals of political and religious controls are imperfectly designed. Mencius shows that the uncultivated man is driven by profit and is repulsed by the demands of morality, making it difficult to found a moral polity. Hsun Tzu believes that the irrationality in man withdraws the popular support from a ritual and rational regime. ;Lao Tzu argues that reality is divided between "good" and "evil," which are themselves defined by conventions. Both "good" and "evil" acquire perpetuity, and even Lao Tzu's proposal of primitivism cannot destroy them. Han Fei similarly conceives reality as composed of both moral and immoral men. His statecraft either lends support to morality or is unable to curb wickedness; accordingly, he is incapable of improving reality. ;Confucius observes that his gentlemanly ideal splits into halves as his students appropriate one mode or the other. The gentleman is underappreciated because those embodying one half or the other of the good are not sympathetic to the full ideal. Chuang Tzu thinks that most people are gripped by partisan points of view, while only a few have transcended partisanship. His ideal personality, combining both partisan and nonpartisan standpoints, would appear suspect to most people. (shrink)

Neste artigo, interrogamos os funcionamentos do conceito de platô em "Mil Platôs" (1980), a obra-prima de Deleuze e Guattari. Essa pesquisa esclarece, de forma concreta, duas linhas de pensamento, que são a epistemológica, por um lado, e a ética, por outro, enfocando os parágrafos nos quais Deleuze e Guattari usam efetivamente esse conceito. Do ponto de vista epistemológico, o conceito de platô permite praticar uma maneira de escrita rizomática e a explicação antiteleológica. Do ponto de vista ético, esse conceito, tirado (...) de Gregory Bateson, nos convida a formar a alegria contínua e global, ou a gaieté em termos espinosistas. In this paper, we question the workings of the concept of plateau in "A Thousand Plateaus" (1980), Deleuze and Guattari's chef-d'oeuvre. This research specifically clarifies two lines of thought, which are epistemological on the one hand, and ethics on the other hand, focusing on the paragraphs where Deleuze and Guattari actually employ this concept. From the epistemological point of view, the concept of plateau allows practicing a way of rhizomatic writing and anti-teleological explanation. From the point of view of ethics, this concept borrowed from Gregory Bateson invites us to form the continuous and global joy, or gaiety in Spinoza's terms. (shrink)

Cultural competence, a clinical skill to recognise patients' cultural and religious beliefs, is an integral element in patient‐centred medical practice. In the area of death and dying, physicians' understanding of patients' and families' values is essential for the delivery of culturally appropriate care. Dementia is a neurodegenerative condition marked by the decline of cognitive functions. When the condition progresses and deteriorates, patients with advanced dementia often have eating and swallowing problems and are at high risk of developing malnutrition. Enteral tube (...) feeding is a conventional means of providing artificial nutrition and hydration to meet nutritional needs, but its benefits to the frail population are limitedly shown in the clinical evidence. Forgoing tube feeding is ethically challenging when patients are mentally incompetent and in the absence of an advance directive. Unlike some developed countries, like the United States of America, death and dying is a sensitive issue or even a taboo in some cultures in developing countries that forgoing enteral tube feeding is clinically and ethically challenging, such as China and Malaysia. This article in three parts 1) discusses the clinical and ethical issues related to forgoing tube feeding among patients with advanced dementia, 2) describes how Hong Kong Chinese, North American, and Malaysian Islamic cultures respond differently in the decision‐making patterns of forgoing tube feeding for patients with advanced dementia, and 3) reiterates the clinical implications of cultural competence in end‐of‐life care. Religious faith and medicine combine harmoniously in Buddhist views, each in its own way helping Buddhists enjoy a more fruitful existence. Health care providers need to understand the spiritual needs of patients in order to provide better care, especially for the terminally ill. Using a recently reported case to guide the reader, this paper examines the issue of medical futility from a Buddhist perspective. Important concepts discussed include compassion, suffering, and the significance of the mind. Compassion from a health professional (...) is essential, and if medical treatment can decrease suffering without altering the clarity of the mind, then a treatment should not be considered futile. Suffering from illness and death, moreover, is considered by Buddhists a normal part of life and is ever-changing. Sickness, old age, birth, and death are integral parts of human life. Suffering is experienced due to the lack of a harmonious state of body, speech, and mind. Buddhists do not believe that the mind is located in the brain, and, for Buddhists, there are ways suffering can be overcome through the control of one’s mind. (shrink)

In this paper, I examine the difference between decision-making by soldiers and commanders, compared with leaders of the nation. Decision-making in the armed forces is prudential reasoning concerned with the best means to achieve given military objectives. I argue that those in the military cannot rationally make the moral choice to risk the lives of their own soldiers or jeopardize their mission in order to protect the lives of enemy civilians. This does not vindicate the realists who deny that morality (...) applies to war. Moral constraints set out in war conventions foster the illusion that by following rules of war, soldiers and their leaders have done all anyone needs to do in terms of moral choice concerning war. Political leaders should instead engage in moral reasoning by considering other means besides war, even the option of changing objectives. Such reasoning differs from prudential reasoning not in scope but in type. (shrink)

Liver transplantation (LT) activities during the COVID-19 pandemic have been curtailed in many countries. The impact of various policies restricting LT on outcomes of potential LT candidates is unclear. We studied all patients on the nationwide LT waitlists in Hong Kong and Singapore between January 2016 and May 2020. We used continuous time Markov chains to model the effects of different scenarios and varying durations of disruption on LT candidates.

This article provides the first-ever comprehensive analysis of how the relationship between the Chinese and Hong Kong legal orders has morphed in nature since China’s resumption of sovereignty over Hong Kong in 1997. It argues that the relationship has evolved from a form of legal pluralism found in the European Union to a monist but bifurcated system—to a “dual state,” to borrow from Ernst Fraenkel’s theory. Recent events, including Beijing’s imposition of a national security law on Hong (...) Kong and its overhaul of Hong Kong’s election methods, have consolidated that evolution. The analysis herein not only enables us to make sense of the developments in the China-Hong Kong relationship, but has five wider theoretical implications. First, it suggests a way of distinguishing a dual state from a fully liberal legal system. Second, it discerns the similarities and differences between legal pluralism and dual state. Third, it connects the literature on theories of legal order and that on the dual state. Fourth, it clarifies the relationship between theories of legal order and regime types. Finally, Hong Kong’s experience reveals the challenges of and potential mechanisms for maintaining liberal values in an authoritarian regime. (shrink)

Emotional creativity refers to a set of cognitive abilities and personality traits related to the originality of emotional experience and expression. Previous studies have found that emotional creativity can positively predict posttraumatic growth and mental health. The outbreak of coronavirus disease 2019 (COVID-19) has posed great challenges to people’s daily lives and their mental health status. Therefore, this study aims to address the following two questions: whether emotional creativity can improve posttraumatic growth and mental health during the COVID-19 pandemic and (...) how it works. To do this, a multiple mediation model has been proposed, which supposes that emotional creativity is associated with posttraumatic growth and mental health through perceived social support and regulatory emotional self-efficacy. The study involved 423 participants from multiple regions with different COVID-19 involvement levels. Participants were asked to complete a questionnaire with six parts, which included Emotional Creativity Inventory (ECI), Regulatory Emotional Self-Efficacy Scale (RES), Stress-Related Growth Scale-Short Form (SRGS-SF), Multidimensional Scale of Perceived Social Support scale (MSPSS), Brief Symptom Inventory-18 scale (BSI-18), and COVID-19-related life events questionnaire. Path analysis used to examine the mediation model indicated that under the control of COVID-19-related life events and age, perceived social support mediated a positive association between emotional creativity and posttraumatic growth as well as a negative association between emotional creativity and all mental health problems, including somatization, depression, and anxiety. Regulatory emotional self-efficacy mediates the association between emotional creativity and posttraumatic growth, emotional creativity and anxiety, and emotional creativity and depression. The results suggest that emotional creativity plays an important role in coping with stressful events related to COVID-19. Furthermore, these results might provide a better understanding of the possible paths through which emotional creativity is related to psychological outcomes, such as mental health and posttraumatic growth.
